White House Flip Flops On Cheney Exemption

cheney1.jpgRegular Wizbang Blue readers will recall Larkin's post on Monday titled 'The Rogue State of Dick Cheney' :

...Cheney has asserted that his office is not bound by certain sections of a presidential executive order that seeks to protect national security information generated by the government. Under the order, offices of the executive branch are required to give the Information Security Oversight Office regular reports on how much material they classify and declassify. Cheney's office provided the information in 2001 and 2002, then stopped.

Basically, the argument they presented was that the Vice-President, who also serves as the president of the Senate, was not a member of the Executive branch and therefore President Bush's Executive Order of March 2003 didn't apply to Cheney. Well, after considerable posturing for a day or two the White House now admits that the Vice-President's interpretation of the matter is incorrect:

Dick Cheney's office is abandoning a justification for keeping the Vice-President's secret papers out of the hands of the National Archives.

Officials working for Cheney had tried to claim he is separate from the executive branch, but they will no longer pursue that defense, senior administration officials tell The Politico.

The White House was forced into flopping on this issue after Rep. Rahm Emanuel (D-IL), the #3 Democrat in the House, threatened to cut the Federal funding for the Vice-President's office. Nonetheless, Emanuel is still pursuing the matter:

Emanuel, who has scheduled a vote on Cheney's funding for Thursday, said the change makes it clear that the White House "told Cheney that he would have to come up with another excuse - that this was not sustainable in the public arena."

Emanuel said the vote is still planned, and said the new position means the vice president needs to comply with National Archives requirements.

This is one arrogant and disingenuous administration. Steve Crickmore replies via email -- "Damn it ... Vice-Speaker would have have looked good on him!". To me, Ex-Vice President looks even better.

And I gather that Leahy has served up some subpoenas for lunch to the critter in the VP office whichever branch he belongs to that's a little more serious.

I still doubt that the Dems have the cajones to deliver him to patriotic Americans like fish on a platter but I am surely getting a kick out of making him squirm a bit. Who knows, maybe the old ticker will just give out due to the stress.

Lee Ward:

I still like the idea that was floated on the Washington Post op-ed pages a few days ago - that Bush would use the heat that is building up against Cheney as leverage to have Cheney resign, at which time Bush would appoint Giuliani or Thompson.

Paul Hamilton:

Larkin: He IS running amok and that is all the evidence I need that he's the real authority in the WH and Bush is just a sock puppet. I'm quite certain that Cheney knew Bush would be a weak president, but that played right into his hands, so naturally he appointed himself to be the power behind the throne.

Lee: I still think that it would be a very bad idea politically to appoint one of the candidates as the new VP. The people of this nation already feel that the administration has been too power-mad and for them to effectively choose their own successor from the field of candidates like that would certainly blow back on them.
